Introduction ​

AirPhoto is a local photo album organization application legally developed and operated by
Hefei Xiguoke Technology Co., Ltd. (hereinafter referred to as “we” or “us”).

This User Agreement (the “Agreement”) is entered into between you (the “User”) and us regarding your use of AirPhoto.
Please read and fully understand this Agreement before using the application.

By using AirPhoto, you acknowledge that you have read, understood, and agreed to be bound by this Agreement.
If you do not agree with any part of this Agreement, please stop using the application.

1. Nature and Scope of Use ​

  1. AirPhoto is provided for personal, non-commercial use only.
  2. Without our prior written consent, users may not copy, sell, rent, sublicense, distribute, or use AirPhoto for any commercial purpose.
  3. Users may submit suggestions or feedback to us, which does not constitute any transfer of rights or obligations.

2. Intellectual Property ​

  1. All intellectual property rights related to AirPhoto, including but not limited to the application itself, interface design, icons, and textual content, are owned by us or the relevant rights holders in accordance with law.
  2. Without authorization, users shall not:
    • Reverse engineer, decompile, or disassemble AirPhoto
    • Modify, adapt, translate, or create derivative works
    • Remove or alter any copyright notices, trademarks, or proprietary identifiers

3. User Conduct ​

3.1 Software Usage Rules ​

When using AirPhoto, users shall comply with applicable laws and this Agreement, and shall not engage in any of the following activities:

  1. Using unauthorized plugins, add-ons, or other methods to interfere with or disrupt normal operation of the application
  2. Using the application to compromise computer information system security
  3. Engaging in illegal, infringing, or rights-violating activities through the application
  4. Any other conduct that violates laws, public order, or this Agreement

If any of the above occurs, we reserve the right to take reasonable measures in accordance with law, including discontinuing updates or support.

3.2 Content Legality Statement ​

AirPhoto is a local photo organization tool and does not collect, review, upload, or distribute any user content.

Users are solely responsible for ensuring that photos, videos, and other content stored or managed on their devices comply with applicable laws and regulations.
Any legal disputes or liabilities arising from user content shall be borne entirely by the user.

3.3 Local Data Statement ​

  1. AirPhoto does not provide account registration, login, cloud storage, or synchronization services.
  2. All content organized and managed within AirPhoto is stored only on the user’s local device.
  3. Users have full control over their local data, including deletion, backup, and management.
  4. Data loss caused by device damage, system reinstallation, accidental deletion, or failure to back up data shall be the sole responsibility of the user.

4. User Privacy and Data ​

  1. AirPhoto does not collect, store, or upload any personal information.
  2. We do not and cannot access any photos or data on the user’s device.
  3. For details on privacy principles, please refer to the AirPhoto Privacy Policy.

5. Service Changes and Termination ​

  1. We reserve the right to update or adjust application features based on product improvements, technical upgrades, or operational needs.
  2. As a local utility application, AirPhoto does not guarantee the permanent availability of any specific feature or version.
  3. This Agreement shall automatically terminate when the user stops using or uninstalls the application.

6. Disclaimer and Limitation of Liability ​

  1. Users understand and agree that AirPhoto is provided “as is”, without any express or implied warranties, including but not limited to merchantability or fitness for a particular purpose.
  2. To the maximum extent permitted by law, we shall not be liable for:
    • Data loss caused by user devices or operating systems
    • Content damage or deletion caused by user actions or misuse
    • Application unavailability due to force majeure or third-party causes

7. Indemnification ​

If the user causes losses to us due to violation of this Agreement or applicable laws, the user shall bear corresponding legal and compensation liabilities in accordance with law.

8. Third-Party Products and Services ​

  1. AirPhoto does not integrate any third-party services, SDKs, or online features.
  2. Any third-party software or services independently used by the user on their device are unrelated to AirPhoto, and all responsibilities shall be borne by the user.

9. Governing Law and Agreement Updates ​

  1. We reserve the right to update this Agreement in compliance with applicable laws and regulations. Updated versions will take effect upon publication within the application or on relevant pages.
  2. If the user does not agree with the updated Agreement, they may stop using AirPhoto. Continued use shall be deemed acceptance of the updated terms.
  3. This Agreement shall be governed by and construed in accordance with the laws of the People’s Republic of China.
  4. Any disputes arising from this Agreement shall first be resolved through friendly consultation. If consultation fails, the dispute shall be submitted to a competent people’s court for resolution.
